Terms of Service

These Terms of Service ("Terms") govern the use of the ERITA mobile application ("App") and all related services. The contracting party is:

By downloading, installing, or using the App, you fully and bindingly accept these Terms.

ERITA is a personal digital dream journal with AI-powered dream analysis. The App offers:

• Recording and storing dream content
• AI-based dream interpretation and analysis (optional)
• Reminder functions
• Data synchronization across devices (optional)
• Personalized settings

IMPORTANT: ERITA is not a medical product and does not replace professional psychological, psychiatric, or therapeutic counseling. Use is for self-discovery and self-reflection purposes.

Minimum Age: You must be at least 16 years old to use ERITA. Users under 18 require parental consent.

Account Registration: Use may require creating an account. You are obligated to provide truthful information and keep your access credentials confidential.

Usage Rights: You receive a non-exclusive, non-transferable, revocable right to use the App in accordance with these Terms.

ERITA is provided "as is". We strive for high availability but do not guarantee uninterrupted or error-free operation.

Maintenance: Scheduled and unscheduled maintenance may cause temporary interruptions.

System Requirements: You are responsible for providing compatible hardware, operating systems, and internet connections.

Free Basic Features: Basic features of ERITA are free to use.

Premium Features: Advanced features (e.g., unlimited AI analyses) may be paid. Prices are transparently displayed in the App.

In-App Purchases: Purchases are made through app store providers (Apple App Store, Google Play). Their payment and refund policies apply.

Subscriptions: Paid subscriptions automatically renew unless canceled in time. The cancellation period is 24 hours before the end of the current period.

You agree to:

• Use the App exclusively legally and in accordance with these Terms
• Not upload harmful content (viruses, malware)
• Not violate third-party rights (copyrights, personal rights)
• Not manipulate, reverse-engineer, or unauthorized copy the App
• Not use automated systems (bots, scrapers) for data collection

Violations may result in immediate account suspension and legal action.

Your Content: You retain all rights to dream content you enter.

Usage License: By using AI features, you grant us a non-exclusive, worldwide license to process, store, and AI-analyze your content – solely for providing our services.

No Sharing: We do not share your dream content with third parties, except as necessary to provide our services (e.g., using OpenAI API) (see Privacy Policy).

Personal data processing complies with the General Data Protection Regulation (GDPR) and Austrian Data Protection Act (DSG). See our Privacy Policy for details.

No Warranty: ERITA is provided without warranty. We assume no guarantee for accuracy, completeness, or reliability of AI-generated dream analyses.

Limitation of Liability: To the extent legally permitted, we are only liable for intent and gross negligence. Liability for slight negligence is excluded unless it involves breach of essential contractual obligations (cardinal obligations).

No Liability for Third Parties: We are not liable for damages caused by third-party services (e.g., App Stores, cloud providers, AI models).

Health Notice: The App does not replace medical or therapeutic advice. For psychological issues, please consult professionals.

Termination by You: You can delete your account anytime in App settings.

Termination by Us: We reserve the right to suspend or delete accounts for violations of these Terms or misuse without prior notice.

Consequences of Termination: After deletion, your data will be removed according to our Privacy Policy. Already paid fees are not refunded unless statutory refund claims exist.

We reserve the right to change these Terms at any time. Changes will be communicated in advance (at least 30 days) via email or in-app notification.

If you do not agree with the changes, you can terminate your account. Continued use after changes take effect is considered acceptance.

Applicable Law: Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods (CISG).

Jurisdiction: Exclusive jurisdiction for all disputes is Klagenfurt am Wörthersee, Austria (where legally permissible).

EU Consumers: EU consumers can use the EU dispute resolution platform: https://ec.europa.eu/consumers/odr

If any provision of these Terms is or becomes invalid, the validity of the remaining provisions remains unaffected. The invalid provision shall be replaced by a legally permissible regulation that comes closest to the economic purpose of the invalid provision.
